2.1. Saru Technologies Pty. Ltd. will, from time to time, receive and store personal information and/or personal data you enter onto our website, provided to us directly or given to us in other forms.

2.2. You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support.

2.3. Additionally, we may also collect any other information you provide while interacting with us.

3.1. Saru Technologies Pty. Ltd. collects personal information and/or personal data from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you. We may receive personal information and/or personal data from third parties. If we do, we will protect it as set out in this Privacy Policy.

4. Use of your personal information and/or personal data

4.1. Saru Technologies Pty. Ltd. may use personal information and/or personal data collected from you to provide you with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information and/or personal data to improve our products and services and better understand your needs.

4.2. Saru Technologies Pty. Ltd. may contact you by a variety of measures including, but not limited to telephone, email, sms or mail.

5. Disclosure of your personal information and/or personal data

5.1. We may disclose your personal information and/or personal data to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. personal information and/or personal data is only supplied to a third party when it is required for the delivery of our services.

5.2. We may from time to time need to disclose personal information and/or personal data to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.

5.3. We may also use your personal information and/or personal data to protect the copyright, trademarks, legal rights, property or safety of Saru Technologies Pty. Ltd., getpylon.com, its customers or third parties.

5.4. Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia. These may include, but are not limited to 'Australia and USA'.

5.5. If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and/or personal data and non-personal information and/or non-personal data contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.

5.6. By providing us with personal information and/or personal data, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information and/or personal data to third parties, we will request that the third party follow this Policy regarding handling your personal information and/or personal data.

6.1. Saru Technologies Pty. Ltd. is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

6.2. The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information and/or personal data that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

7. Access to, and management of your personal information and/or personal data

7A For Australian Residents for which the Privacy Act 1988 (Cth)

7A.1. You may request details of personal information and/or personal data that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth) and General Data Protection Regulation (as the case may be). A small administrative fee may be payable for the provision of information. If you would like a copy of the information which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at support@getpylon.com.

7A.2. Where you are and Australian resident, we reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.

7B For European Parties for which the General Data Protection Regulation Applies

7B.1. What are your rights?
You have certain rights regarding your personal data. These include the rights to:

  • request a copy of the personal data we hold about you;
  • request that we supply you (or a nominated third party) with an electronic copy of the personal data that you have provided to us;
  • inform us of a correction to your personal data;
  • exercise your right to restrict our use of your personal data
  • exercise your right to erase your personal data; or
  • object to particular ways in which we are using your personal data such as automated decision making, or profiling (for example to help us decide what products and services would suit you best); or
  • understand the basis of international transfers of your data by us.

Where we rely on our legitimate interests to obtain and use your personal data then you have the right to object if you believe your fundamental rights and freedoms outweigh our legitimate interests. Where processing is carried out based upon your consent, you have the right to withdraw that consent.

Your ability to exercise these rights will depend on a number of factors and in some instances, we will not be able to comply with your request e.g. because we have legitimate grounds for not doing so or where the right does not apply to the particular data we hold on you.

You should note that if you exercise certain of these rights we may be unable to continue to provide some or all of our services to you (e.g. where the personal data is required by us to comply with a statutory requirement or is necessary in order for us to perform our contract with you).

You may also exercise a right to complain to your Supervisory Authority (see https://edpb.europa.eu/about-edpb/board/members_en for a list of national supervisory authorities). Please contact the GDPR Panel if you wish to exercise any of your rights.

7B.2. No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

7B.3. What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

7B.4. Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. Please note there may be some latency in deleting your personal data from all our systems and those of any third parties which process such data on our behalf.

8. Complaints about privacy

9. Website

9.1. When you visit our Website

When you come to our website (getpylon.com) we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.

9.2. Cookies

We may from time to time use cookies on our website. Cookies are very small files which a website uses to identify you when you come back to the site and to store details about your use of the site. Cookies are not malicious programs that access or damage your computer. Most web browsers automatically accept cookies but you can choose to reject cookies by changing your browser settings. However, this may prevent you from taking full advantage of our website.

9.3. Advertisements

Our website may from time to time use cookies to analyses website traffic and help us provide a better website visitor experience. In addition, cookies may be used to serve relevant ads to website visitors through third party services such as Google Adwords. These ads may appear on this website or other websites you visit.

9.4. Third party sites

Our site may from time to time have links to other websites not owned or controlled by us. These links are meant for your convenience only. Links to third party websites do not constitute sponsorship or endorsement or approval of these websites. Please be aware that Saru Technologies Pty. Ltd. is not responsible for the privacy practises of other such websites. We encourage our users to be aware, when they leave our website, to read the privacy statements of each and every website that collects personal identifiable information.

10. Data retention

10.1 We will retain your personal data for as long as necessary to fulfill the purposes for which it was collected, or to comply with our legal obligations, resolve disputes, and enforce our agreements. Once we no longer have a legitimate need to process your information, we will delete or anonymize it from our databases.

Specific Retention Periods

  • For client data processed within the service, we will delete the data of closed accounts within 180 days of the date of closure.
  • For Free Trial accounts, we will delete all content within 60 days of date of closure.
  • Our server archival backups are kept for 90 days before being deleted.

You may request your data to be deleted sooner by contacting consents@getpylon.com.

11. Google User Data

11.1 The App will only use access to read, write, modify or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read,and process emails and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.

11.2 The Terms will continue to apply until terminated by either you or by Pylon as set out below.

11.3 The App will not use this Gmail data for serving advertisements.

The App will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the App's internal operations and even then only when the data have been aggregated and anonymized.

Pylon's use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

12. Changes to Privacy Policy

12.1. Please be aware that we may change this Privacy Policy in the future. We may modify this Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board.
